MINDGREEN LAUNDRY INC. (“MINDGREENLAUNDRY.COM”), Terms and Conditions of Service:
The following terms and conditions govern your use of MINDGREENLAUNDRY.COM’s services. As a condition to using any of MINDGREENLAUNDRY.COM’s services, MINDGREENLAUNDRY.COM and the undersigned customer (“Customer”) agree to the following terms and conditions:
Service Enrollment: Customer can enroll MINDGREENLAUNDRY.COM’s services by Calling us at 347-927-9274 or 718- 526-1628, Using SMS text Message at 347-927-9274 or Filling out our online schedule form at our website www.mindgreenlaundry.com in order to schedule a pick-up under these terms and conditions.
Pick-Up Schedule: MINDGREENLAUNDRY.COM always strives to pick up at Customer’s location on time. However, the safety of employees, agents and pedestrians takes precedence. In cases of bad weather, traffic congestion or other occurrences beyond our control it may be necessary to make adjustments to pick-up schedule, which will cause MINDGREENLAUNDRY.COM to suspend chosen pick-up dates and times. In such case, MINDGREENLAUNDRY.COM may call or SMS text or E-mail Customer to let you know the status of pick-up dates and time. MINDGREENLAUNDRY.COM reserves the right to determine pick-up times at its discretion and reserves the right to re-schedule such times upon prior notice to Customer.
Pick-Up and Delivery: Customer agrees to include only (1) washable items in the bag(s) and (ii) items that can be dry-cleaned, pressed, or cleaned in accordance with any instructions or requests provided by Customer in the bag(s). (iii) Price for "wash and fold" is based on exact weights (pounds). "MINDGREENLAUNDRY.COM” can only determine the exact weight (pound) of your bag(s) and consequently the total price of your order only after we pick up and weight your items on our scale at our location. If Customer does not have a “MINDGREENLAUNDRY.COM” bag(s) available, Customer may leave clothing for pick-up in any available bag(s). Customer provided bag(s) may not be returned to Customer. It is Customer’s responsibility to deliver the dirty laundry bag(s) to a MINDGREENLAUNDRY.COM representative at the appointed location and time. MINDGREENLAUNDRY.COM will communicate the pick-up/delivery schedule to Customer via phone, SMS Text Message or E-mail for convenience.
Missed Delivery or Pick-Up: Customer may contact MINDGREENLAUNDRY.COM to arrange “on call” additional pick-up dates. MINDGREENLAUNDRY.COM is not responsible for and shall not pay for, any loss, damage or theft of items left unattended for pick-up-or drop-off, whether left by Customer or MINDGREENLAUNDRY.COM.
Payment: Customers will be billed by credit or debit card, Cash and Bank check on Delivery or Sqaure invoice via E-mail provided by Customer. MINDGREENLAUNDRY.COM reserves the right to change billing terms at any time without prior notice. MINDGREENLAUNDRY.COM may bill customer before delivery of each order. If MINDGREENLAUNDRY.COM is unable to collect payment, MINDGREENLAUNDRY.COM reserves the right to withhold delivery until such time as payment is made for all services performed. Customers must maintain a valid credit or debit card number on file with MINDGREENLAUNDRY.COM. Customer hereby authorizes MINDGREENLAUNDRY.COM to charge its credit or debit card for all charges for any given month or delivery. In the case of Check issued by Customers with Customers' Bank returned by Non-Sufficient-Fund, Customers acknowledge that MINDGREENLAUNDRY.COM reserves the right to charge any bank fees incurred by the returned check. Customer consents to the billing of its credit or debit card for such charges, and agrees to pay for all services. If a client’s bill remains unpaid for more than thirty (30) days from the billing date (Pick-up Date), MINDGREENLAUNDRY.COM will add a service charge of Fifteen percent (15%) each month to the unpaid balance. Customer agrees to be responsible to pay all of our reasonable fees of collecting any unpaid balances and legal fees.
“Wash and Fold” Service: "wash and fold" service will be performed with the utmost care and with the highest cleaning standards. Customer acknowledges that MINDGREENLAUNDRY.COM does not catalogue each individual item included within “wash and fold” loads, but instead accounts for “wash and fold” loads received from Customer by weight (pound). MINDGREENLAUNDRY.COM is not responsible for the loss of “wash and fold” items, unless otherwise stated by the customer with a note on the “wash and fold” bag(s), “wash and fold” bag(s) will be weighted before being processed. Our price for "wash and fold" is based on exact weights (pounds). MINDGREENLAUNDRY.COM can only determine the exact weight (pound) of bag(s) and consequently the total price of Customer's order only after we pick up and weight "wash and fold" bag(s) on our scale at MINDGREENLAUNDRY.COM's location.
In addition, your clothes are washed, dried and folded separately from other customers. Therefore there is no chance of losing any items. Please note that we wash, dry and fold your clothes in a very strict and controlled environment and therefore we are not responsible for any lost items. Please empty all pockets as are not responsible for items you leave in the pockets that may get damaged or damage other items during the washing process.
Additional Charges: MINDGREENLAUNDRY.COM reserves the right to charge additional fees for items that cost more to clean. Note that items like blankets, comforters, rugs, sneakers, and low temp delicate drying cost more to "wash and fold". The cost is determined based on the item size and it's because we must wash and dry separately from other garments.
Special Care Instructions: In order to request special care for any garment, including leather, suede, fur, satin, area rugs, comforters, and draperies, Customer must include such special care instructions in the MINDGREENLAUNDRY.COM “dry-clean & press” bag or, if the bag contains more than one item, attach the special care instructions to the item(s) subject to the special care instructions. If a special request is not present in Customer’s laundry bag before the time of processing, MINDGREENLAUNDRY.COM reserves the right to clean that item in its sole discretion.
Garment Care and Missing or Damaged Goods: MINDGREENLAUNDRY.COM reserves the right to refuse to clean any garment. MINDGREENLAUNDRY.COM does not guarantee removal of all stains. MINDGREENLAUNDRY.COM will re-clean items that were not completely cleaned and not yet worn since cleaning. MINDGREENLAUNDRY.COM is not responsible for loss of or damage to any personal or non-cleanable items left in the clothing or bags. MINDGREENLAUNDRY.COM is not liable for damage to or loss of clothing due to any third party cleaners or service providers. Customer must notify MINDGREENLAUNDRY.COM within 2 days (48 hours) of receipt of a delivery of any lost or damaged items from that particular delivery. Failure to do so constitutes waiver of a claim for any lost or damaged items from that delivery.
Service Providers/Disclaimer of Certain Liabilities: MINDGREENLAUNDRY.COM reserves the right to utilize any outsourcer, vendor, or outside service provider, for any service, at its sole discretion without notice to Customer.
Disclaimer: MINDGREENLAUNDRY.COM’s liability is solely limited to money damages in an amount not to exceed ten times the charges for the cleaning of the garment at issue. Customer waives any consequential, special, indirect, incidental, or punitive damages from MINDGREENLAUNDRY.COM, irrespective of whether MINDGREENLAUNDRY.COM knew or should have known of the likelihood of any loss or damages. Customer is responsible for all damage to clothing, cleaning machines, or anything else when caused by any items present in the laundry bag(s). MINDGREENLAUNDRY.COM bears no responsibility for any damages arising from the regular cleaning of special care items when Customer fails to provide special instructions regarding those special care items. MINDGREENLAUNDRY.COM shall have no liability for damage due to normal cleaning of items without care instructions and no liability for items treated in accordance with the care labels or other instructions provided. MINDGREENLAUNDRY.COM shall have no liability for trimmings, buckles, beads, buttons, belts, and sequins.
Interior Access To Property For Delivery, Hold Harmless/Indemnification: If access to the Customer’s property for delivery of clothing and other specialty items is allowed; Customer hereby waives any and all claims against MINDGREENLAUNDRY.COM and its agents and employees for damage to or loss of use of property that arise as a result of Customer allowing access to its or other’s property for the purpose of delivery. Customer agrees to indemnify and hold harmless MINDGREENLAUNDRY.COM and its agents, and employees for any bodily or personal injuries arising from Customer allowing access to its property to MINDGREENLAUNDRY.COM.
Items left or undelivered: MINDGREENLAUNDRY.COM understands that New York is filled with forgetful geniuses and procrastinators alike. So, as a courtesy to you; in case something unexpected prevents you from picking up or scheduling your delivery, we will reluctantly keep your laundry for up to 30 days and your dry cleaning for up to 60 days. However, due to high storage cost and the small size of our facility, we will not be responsible for your items if they are left here for longer than what is stated in this policy. So, just to recap, MINDGREENLAUNDRY.COM is not responsible for laundry left here for more than 30 days and dry cleaning for more than 60 days.
Entire Agreement/Choice of Law: These terms and conditions may not be modified except in writing signed by both parties, and shall be governed by the laws of the State of New York.
Arbitration: All disputes and differences of any kind arising under these terms and conditions or arising between Customer and MINDGREENLAUNDRY.COM, including the existence or continued existence of this Agreement and the arbitrability of a particular issue that the parties cannot settle amicably, shall be submitted to binding arbitration. The arbitration shall be conducted in New York and shall finally be settled in accordance with the Rules of Arbitration of the American Arbitration Association by one arbitrator appointed in accordance with the above mentioned rules. The arbitrator shall be allowed to apportion fees according to the ruling.
The decision of the arbitrator shall be final and binding upon the parties and may be enforced in any court of competent jurisdiction, and no party shall seek redress against the other in any court or tribunal except solely for the purpose of obtaining execution of the arbitral award or of obtaining a judgment consistent with the award. Any costs so incurred shall be paid by the losing party. In the event of legal proceedings, Customer agrees to waive its right to a trial by jury.
Ownership of This Website: This website is owned and operated by MINDGREENLAUNDRY.COM. All of the content featured or displayed on this website, including, but not limited to, text, graphics, photographs images, moving images, sound, illustrations, and software (“Content”), is owned by MINDGREENLAUNDRY.COM, its licensors and its content providers.
All elements of MINDGREENLAUNDRY.COM websites, including, but not limited to, the general design and the Content, are protected by copyright, moral rights, trademark and other laws relating to intellectual property rights.
